Service Description

OptionsWave is an earnings options research tool. Every trading day before the open, the Service scans a fixed list of stocks with upcoming earnings, compares the average first-session maximum move of each stock's last four earnings releases with the move priced by the at-the-money straddle at the previous session's closing asks, and lists the stocks where the historical average is higher as candidates. Candidates are ideas for review, not validated trade recommendations, and closing quotes are indicative, not live prices. Features include the scanner list, the evidence page of each result, an earnings calendar, and bookmarks.

Data Sources and Accuracy

Our analysis uses data from publicly available financial data sources and third-party market data providers.

While we strive for accuracy, we cannot guarantee the completeness, reliability, or timeliness of any data. Market data may be delayed. Data providers may experience outages or errors. You should independently verify any information before making trading decisions.

User Accounts

You must create an account to access the full Service. Account authentication is managed by Clerk, a third-party provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior, including excessive automated access, scraping, or attempts to circumvent rate limits.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Scrape, crawl, or systematically extract data from the Service
• Redistribute, resell, or republish our analysis or trading signals
• Interfere with or disrupt the Service or its infrastructure
• Misrepresent OptionsWave signals as personalized investment advice to others

Intellectual Property

All content, analysis methodologies, algorithms, and design elements of the Service are owned by OptionsWave or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY TRADING SIGNALS, ANALYSIS, OR INFORMATION PROVIDED THROUGH THE SERVICE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIONSWAVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES, WHETHER CAUSED BY TORT, CONTRACT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless OptionsWave and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your trading decisions made in connection with information obtained through the Service.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
